Filing a Complaint
The
South Metro Denver REALTOR® Association (SMDRA) is a professional
trade association representing the interests of real estate professionals in
the South Metro Denver area. It is one of the largest local REALTOR®
Associations in the state of Colorado which has been granted the charter to
use and monitor usage of the term “REALTOR®” by the National
Association of REALTORS® (NAR). REALTOR® is a
registered mark which identifies a professional in real estate who
subscribes to a strict Code of Ethics as a member of the REALTOR®
Association.
The
Code of Ethics is universally recognized by practitioners, lawyers and
laymen alike as the measure of professionalism in real estate. Every
REALTOR® is required to take ethics update training every four years.
However, in the unfortunate event you have a complaint against a SMDRA
member based on a possible violation of the REALTOR® Code of Ethics; please contact Melissa Maldonado, Professional Standards

melissa@smdra.com. Please understand that SMDRA administers the
complaint or arbitration process and can answer procedural questions, but
cannot give legal or other advice.

in mind the following if you choose to file an ethics complaint:

Only REALTORS®
are subject to the Code of Ethics of the National Association of
REALTORS®.

If the real estate
professional (or their broker) you are dealing with is not a REALTOR®,
your only recourse may be the state real estate licensing authority or
the courts. Boards and associations of REALTORS® determine
whether the Code of Ethics has been violated, not whether the law
or real estate regulations have been broken. Those decisions can only be
made by the licensing authorities or the courts. If you would like to
file a complaint regarding possible license law violation with the

Boards of REALTORS®
can discipline REALTORS® for violating the Code of Ethics.
Typical forms of discipline for ethical violations include attendance at
courses and seminars designed to increase REALTORS®'
understanding of the ethical duties or other responsibilities of real
estate professionals. REALTORS® may also be reprimanded,
fined, or their membership can be suspended or terminated for serious or
repeated violations. Boards and associations of REALTORS®
cannot require REALTORS® to pay monetary awards to parties filing
ethics complaints; cannot award "punitive damages" for violations of the
Code of Ethics; and cannot suspend or revoke a real estate
professional's license.
